The bigger question is how someone ends up in court for this when racially abusing Swansea footballer gets you a temporary ban on Instagram.
Exactly, it obviously isn't deemed offensive enough.

"Communications Act 2003, which states a person is guilty of an offence if he or she sends “by means of a public electronic communication network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character”.

Who deems what is grossly offensive, is there a list? I don't really know how I feel about this law, seems like you can just shift the goal posts. It was a terrible thing to write but he should have just been banned and that's it.

Having said that someone here needs to go to jail for suggesting CT is a nonce.
