I found a fix for the slow download speeds if it helps anyone, the Xbox throttles downloads while in-game, if there's a game in quick resume the console still thinks it's being played and will carry on throttling speeds.
If you manually quit the game from the home screen, download speeds will return to normal.

Hopefully this can be sorted in an update soon, seems like there are quite a few bugs around the quick resume feature.
