Right, I ordered a Samsung 913n alsmot two weeks ago and I have had it just over a week but teh company I ordered it from have not charged my card, I also orderded a router from the same company but do not know if they have charged me for it yet. What are my rights If I don't tell them as its thier mistake? Also what are thier rights as I don;t mind payting them as I have the stuff its just it would be nice not to. |

I don;t know if the router was signed for as I was not in at the time (brother was) but I am not sure if the monitor was signed for or not, I think it was.
Either way, I am happy to pay for the stuff as said earlier as I brought it knowing the cost and have the money for it, its just that if I don't have to pay for it I can have something else

You've got a contract, given them your card details and have complied with your obligations. They've complied with theirs. You can't force them to take your money! They'd be within their rights to notice their mistake and take the money out of your account though.
But - if, for example, you're overpaid by your employer or if cash machine gives you fifty quid instead of a tenner then you ARE obliged to tell them of the mistake. They're within their rights to demand the money back. Maybe (that's MAYBE) that would apply here.
In practice though you're probably fine. If you're a decent upstanding citizen you should prob tell them though

I'd like to think I am a decent person but in all honesty I will most likely not tell them, but if they ask about it or charge me then fair play as its thier money. -

Call you bank and tell them you broke your card (by accicent) and ask them to give you a new one (It can take a week).
The new card will almost certainly have a new number. The company cannot then take the money 'when it wants to/realises' and will have to arrange it with you.
If you paid by supplying your ABNK details though, that's different/ -

Good Idea, but I am not going to do that, I am honest enough to let them take the money back if they realise thier mistake but not honest enough to tell them about it
