Calling all professional photography/design type people: I've just created a piece of digital art for a client to exclusively use as artwork for his new business venture. He commissioned it and will be the sole user. What should I be detailing in terms of copyright sale etc on the invoice? Should I be selling him the copyright and all future usage rights but stating that I retain the right to display the image as part of my portfolio? Or should I be selling him all the usage rights and general exclusivity to the images, and retaining the copyright? What's the general procedure? Cheers. |

Sorry, I don't follow you...
I'd want to be ablee to show the image on my website as work I have done, or to print myself for my own hardcopy portfolio.
I'm more interested in what I need to put on the invoice to cover what it is he wants (the guarantee of full image exclusivity, to use as he sees fit forever and ever amen). I'm just concerned I don't give away what I don't need to, copyright-wise. -
Don't know if it's any help but the way Architect's drawings are usually dealt with is that the client is granted a licence to use, reproduce and distribute the drawings so far as they are used for the construction of the works and any extension / remedial works in the future but that the Architect himself retains the copyright. -

We did, pretty much. We agreed that the images were entirely his, for his own personal business use, and nobody else would ever be able to buy them from me or use them - they are HIS. I just wasn't sure how to word this in terms of copyright/usage rights etc. Cheers for the help!

you can do this whatever happens, unless the client has specifically requested otherwise

That's up to you and your client to decide though and you should really have decided it before the job took place....
